簡(jiǎn)介:國(guó)際慣例FIDIC與水利水電工程施工合同和招標(biāo)文件示范文本這兩個(gè)合同管理模式在我國(guó)應(yīng)用的時(shí)間較短,因此,不論從理論上還是從實(shí)踐上講,在國(guó)內(nèi)都處于初期階段,F(xiàn)IDIC存在著不可避免的局限性,而范本管理模式是在參照FIDIC合同管理模式的基礎(chǔ)上形成的,雖然加入一些適合目前國(guó)情的具有中國(guó)特色的內(nèi)容,但是仍存在一定的問題。本文在分析水利工程合同管理模式現(xiàn)狀的基礎(chǔ)上,提出了進(jìn)行合同管理模式比較研究的問題和必要性。論文圍繞此目標(biāo),對(duì)合同管理模式的應(yīng)用背景、合同條件的形式進(jìn)行了闡述,并深入分析了合同條款形式、依據(jù)的法律法規(guī)、條款內(nèi)容等方面問題。通過對(duì)比分析范本與FIDIC合同管理模式在合同條件上的不同之處,結(jié)合工程實(shí)際,分析了合同條款的內(nèi)容及其隱含條件,指出了二者存在的差異與利弊。論文對(duì)水利工程合同條件中的變更和索賠做了對(duì)比研究,提出了變更審查原則,索賠存在問題與處理方法,總結(jié)分析了范本模式中監(jiān)理的合同管理問題和相應(yīng)措施。相信隨著我國(guó)水利工程四項(xiàng)制度改革的不斷深化,認(rèn)識(shí)與理論水平的提高,一定會(huì)逐步形成全面的、完善的水利工程合同管理模式。
