簡(jiǎn)介:秦漠遭坐制及法制史的若干同題研究THERESEARCHONTHESYSTEMOFJOINTRESPONSIBILITYANDSOMEISSUESOFTHELEGALHISTORYINTHEZHANGUO,QINANDHANPERIODS博士後姓名水同大鞴流勤站一級(jí)孥科名稻廢門大孥屋史孥喜柒二級(jí)孥科名稻中園古代史研究工作起始疇同2011年11月研究工作期滿疇同2013年11月廢朗大掣2013年9月內(nèi)容摘要本文前半第一章至第四章探封了秦漠疇期速坐制的燮遙及其背景?!叭逍獭狈夥溉说母改浮⑵拮有峙?、同麈虞以死刑的刑翻的起源是戮囡疇期君主扇了碓保臣下的忠馘,將其覯屬扣作人貿(mào)。雕然族刑己徒其以前陰始寅施,但造入戟固疇期後,族刑的通用筢圉固定并縮濺到“三族”。遣是因焉戟囡疇期家庭的規(guī)模一般己縮濺,將三族以外規(guī)屬加以虞蜀的必要性濺退。而且,戟固疇期多有雒陰出身園到刖圓做官的人,他們均徒自己的宗族分立,揣帶的覯屬亦較少。扇了碓保他們的忠馘,道用族刑的筢國(guó)有三族則足麴。漠初反後了三族刑的賡除和制定,但文帝後元元年至七年之同再次制定以後,沒(méi)有賡除而沿用至漠末。賡除三族刑的背景有戟園以束的三族刑賡除輸,以及解除秦朝苛法遣一漠朝基本固策。相封於此,重新制定三族刑,則是由於通遇封呂氏政榷的政燮及新垣平的大逆案件,重新韶讖到三族刑的威憬效果,以及賡除三族刑避沒(méi)有給圓家?guī)?lái)寅陳益虞?!笆真邸睕](méi)收犯人的妻子兄女焉官奴婢的刑蜀賡除于西漠文帝元年,但其寅以後亦屢次揉取同檬的措施。文帝元年以後的遣檀措施輿此前的收孥不相同,是作扇死刑的代替刑逋用的,其作用是在不賡除三族刑的前提下,將其向著更扇緩和的方向調(diào)箭。本文後半第五章至第七章分別探討了網(wǎng)於秦漠法制史的三倜同題,即①“躲官”的裙羲及其燮暹、背景;②眼家山漠筒奏讞害案例20所兄“魯法”的成立年代;③里耶秦筒所兄的“牢監(jiān)”、“牢人”。網(wǎng)鍵翮秦漠連坐三族刑收孥躲官魯法牢盛牢人
