簡介:在當(dāng)今共產(chǎn)主義運動經(jīng)過一系列不斷的運動高潮而暫時遭受了重大挫折陷入低潮,而又不斷地進(jìn)一步發(fā)展著的世界,呈現(xiàn)出資本主義制度與現(xiàn)有的社會主義國家并存的世界格局,而且這兩種制度存在幾乎同時進(jìn)入了新的繁榮,整個世界范圍內(nèi)不僅無產(chǎn)階級表現(xiàn)出了新的特點,整個資本主義發(fā)展也呈現(xiàn)出了新的特征??v觀當(dāng)前的世界,人的異化不僅表現(xiàn)在物的異化,而且表現(xiàn)在人的精神異化。異化現(xiàn)象已經(jīng)滲透到人的各個層面,并表現(xiàn)出極強的隱蔽性和不可察覺性,它不僅改變了勞動與資本之間表面上直接沖突的形式,而且還以理性規(guī)勸、價值懸設(shè)等隱形、柔化的形式,讓無產(chǎn)階級逐步喪失了自身的階級意識,阻礙著人們對自身異化的超越以及精神解放的實現(xiàn)。這無疑影響著對于馬克思主義的理解和應(yīng)用??v觀馬克思對于異化勞動與人的解放的研究。馬克思在吸收前人理論成果,深刻分析了資本主義制度與社會現(xiàn)實的基礎(chǔ)上,以新唯物主義為方法,既指證了異化勞動是私有制的產(chǎn)物,又證明了異化勞動的存在也必然導(dǎo)致資本主義私有制的消亡。而人的精神解放作為人的解放的必要環(huán)節(jié)和重要內(nèi)容之一,在認(rèn)識論上,對人變革現(xiàn)實世界,實現(xiàn)人的解放具有決定性或者關(guān)鍵性的作用,而也惟其如此,異化勞動的消除也必然與人的解放聯(lián)系在一起,統(tǒng)一于偉大的共產(chǎn)主義運動。而人的精神解放作為人在現(xiàn)實社會中從事物質(zhì)實踐活動的結(jié)果,不僅變革著人的精神世界,實現(xiàn)著人們對于現(xiàn)實世界的更為深刻的認(rèn)識,而且,也必然隨著思想或者精神更符合客觀實際,而實現(xiàn)更好的改造現(xiàn)實世界,為實現(xiàn)人的全面解放創(chuàng)造有利條件,最終實現(xiàn)人的解放。馬克思主義本身就是不斷發(fā)展的理論,而馬克思主義面對的現(xiàn)實問題更是不斷發(fā)展的現(xiàn)實,就此而言,面對活生生的現(xiàn)實生活,尤其是面對資本主義不斷出現(xiàn)的新情況和新問題,面對馬克思主義誕生以來出現(xiàn)的共產(chǎn)主義運動的挫折與低谷,不僅必須既堅定中國特色社會主義的共同理想,更堅定共產(chǎn)主義的遠(yuǎn)大理想,不斷發(fā)展生產(chǎn)力,而且,必須在認(rèn)真深入理解馬克思主義基本精神的基礎(chǔ)上,不斷地發(fā)展馬克思主義,堅持改革開放,堅持解放思想,推動人的精神解放,通過人對世界的認(rèn)識與改變,使得人不僅從整個自然界中獲得獨立,獲得自由,而且,也從私有制所造成的異化中獲得獨立,獲得自由,真正地實現(xiàn)人的全面解放。

簡介:本文所說的“吳門醫(yī)派”,是明清時期以吳中溫病學(xué)派為主,兼及師承吳醫(yī)名家的江南中醫(yī)流派。吳門醫(yī)派主要特征是名醫(yī)眾多,療效顯著,著作豐碩,生命哲學(xué)和生命科學(xué)理論先進(jìn)。吳門醫(yī)派對傳統(tǒng)中醫(yī)經(jīng)典理論進(jìn)行發(fā)揮,并結(jié)合明清之際傳入的西方生命科學(xué),再次尋求生命本源,提出了“先后天本源論”、“元質(zhì)元神論”、“血氣關(guān)系論”、“衛(wèi)氣營血論”、“生命體質(zhì)論”等生命學(xué)說,從而構(gòu)建出一個完備的生命本源論及生命發(fā)展論體系。薛己在“腎為先天之本”的基礎(chǔ)上,提出人以胃氣為后天之本,脾胃為人身根蒂的之論。繆希雍在論證了“氣”、“血”之間及“血氣”與神、津、液、精之間相互生成,相互轉(zhuǎn)化的過程,重點研究脾胃構(gòu)造論,提出脾胃為后天元氣之根本說。王宏翰提出了元神元質(zhì)說、命門胎生說等新的生命本源論。葉天士提出了“衛(wèi)氣營血辯證法”,論證了后天之氣可以補助先天元氣,對內(nèi)傷雜病治療提出脾胃分治論。徐大椿著元氣存亡論,指出先天元氣是生命之根,完善了中醫(yī)氣化生命學(xué)說。吳門醫(yī)派提出了人體“體質(zhì)”、“體質(zhì)差異”和“體質(zhì)病變”等概念,認(rèn)為體質(zhì)就是人體先天稟賦和后天營養(yǎng)的綜合特性,在生理表現(xiàn)上,不同個體具有特殊性,且隨著生命過程不斷變化。吳門醫(yī)派身心觀即身體觀與心理觀合稱,主要回答“身體”是什么,“心理”是什么,“身體”與“心理”的關(guān)系如何等問題。在吸收西方近代生命科學(xué)基礎(chǔ)上,在身心神情意關(guān)系上提出了“心神為體,腦神為用”的命題。同時在身體骨骼結(jié)構(gòu)論研究中做出了重要貢獻(xiàn),對髓理論研究也取得重要進(jìn)展,為后世腦髓學(xué)說的興起奠定了基礎(chǔ)。吳門醫(yī)派探討經(jīng)絡(luò)理論,將絡(luò)病理論用于溫?zé)岵≈委?,提出?jīng)絡(luò)三焦論。吳門醫(yī)派秉持動靜結(jié)合、藥食同源等中醫(yī)養(yǎng)生理論,在動養(yǎng)、靜養(yǎng)、藥膳、食療與生態(tài)養(yǎng)生等方面,形成了富有江南區(qū)域特色的,修與養(yǎng)兼?zhèn)涞男吗B(yǎng)生論。吳門醫(yī)派提出“五臟次第衰老論”和“迫生順?biāo)勒摗保谒劳龆x上注重人的精神特征和社會特征,強調(diào)遠(yuǎn)死而近生、向死而生等新死亡觀,認(rèn)為尊重死者撫慰生者是對生命的真正尊重。

簡介:南京師范大學(xué)碩士學(xué)位論文合法化、合理性與正義程序訴訟程序的哲學(xué)之維姓名韓德明申請學(xué)位級別碩士專業(yè)訴訟法學(xué)指導(dǎo)教師李力200351合法化、合理性與J下義程序第3頁共57負(fù)摘要,F(xiàn)F基于分離的事實與規(guī)范的整合需求,訴訟程序獲得了合法性前提,并因內(nèi)在于程序規(guī)則的事件的挑戰(zhàn)和外在于程序規(guī)則的事件的介入而合法化。得以合法化的訴訟程序勢必有其合理性實踐訴求,對此,本文結(jié)合訴訟程序兩種實踐模式一一職權(quán)主義和當(dāng)事人主義一一所表征的兩種合理性內(nèi)涵,指明職權(quán)主義程序模式的工具目的合理性性質(zhì)和當(dāng)事人主義程序模式的規(guī)范價值合理性性質(zhì)/并認(rèn)為它們都是單向度體現(xiàn)了訴訟程序的合理性精神。進(jìn)而,Y本文引入交往合理性理論,以其作為理論工具分析了訴訟程序的合理性問題,指出訴訟程序涉及犯罪糾紛事實、法律規(guī)范和主體意志三種本體論范疇,從而真正體現(xiàn)合理性的訴訟程序應(yīng)當(dāng)是追求真實、體現(xiàn)正當(dāng)、主體真誠的三位一體。對此,本文還借用語用學(xué)工具,進(jìn)一步分析和論證了訴訟程序以上三個方面的合理性要求。由于職權(quán)主義或當(dāng)事人主義訴訟程序模式具有刻意設(shè)計的原因,從而作為唯理性設(shè)計的方案在實踐落實上必然難逃自我解構(gòu)的命運。對兩種唯理性設(shè)計的程序模式進(jìn)行解構(gòu)主義閱讀的結(jié)局,是程序的多元主義或語境主義。當(dāng)然,程序多元主義或語境主義并非對表征交往合理性的訴訟程序理念的顛覆,恰恰相反,程序多元主義正是對程序交往合理性要求的捍衛(wèi)和保證。關(guān)鍵詞訴訟雜殍合法性交往各運,洼語用事正義茬序,程序解構(gòu)
