1、W市流動人口的取保候審情況調研報告1內容摘要大規(guī)模的人口流動是我國社會經濟發(fā)展中出現的客觀現象，也是市場經濟條件下勞動力資源市場配置的必然結果，這一現象的出現與我國僵化的戶籍制度存在密切關聯。被標簽化為“流動人口”的社會群體由于各種原因，犯罪率相對較高，如何對流動人口群體適用刑事強制措施，實現刑事訴訟程序保證和犯罪嫌疑人、被告人權利保護的平衡，是刑事訴訟法律實施過程中難以回避的問題。以取保候審為例，流動人口涉罪人員適用取保候審的比例較低

2、，這一現象的成因較為復雜，表面原因是流動人口涉罪人員無法提供足夠的保證金或提出合格的能夠履行保證義務的保證人，但根本原因是我國《刑事訴訟法》還沒有確立起“保釋是常態(tài)，羈押是例外”的原則，羈押性強制措施適用比例偏高，取保候審在內的非羈押性強制措施沒有得到足夠的重視。通過實證研究、規(guī)范研究、比較研究等法學分析方法，本文分析了流動人口取保候審實踐中存在的問題，分析其成因，并反思了現行的取保候審制度，提出了相關完善意見。正文可以分為四個部分，每
