1、摘要物權(quán)請求權(quán)，又有人稱其為物上請求權(quán)、物的請求權(quán)或者基于物權(quán)而生的請求權(quán)，是指物權(quán)人于其物權(quán)受到侵害或有被侵害的危險時，請求侵害人為一定行為或者不為一定行為，從而使物權(quán)回復(fù)到其原有狀態(tài)的權(quán)利。物權(quán)請求權(quán)應(yīng)分為抽象意義上的物權(quán)請求權(quán)與具體意義上的物權(quán)請求權(quán)，抽象意義上的物權(quán)請求權(quán)與物權(quán)的積極權(quán)能，即物權(quán)的支配效力相對應(yīng)而存在，其蘊藏于物權(quán)本體之中，而并非一種有形之權(quán)利；而具體意義上的物權(quán)請求權(quán)則于物權(quán)遭受侵害或者侵害之虞而發(fā)生，包括：返

2、還原物請求權(quán)、妨害排除請求權(quán)與妨害預(yù)防請求權(quán)，而不包括確認物權(quán)請求權(quán)、恢復(fù)原狀請求權(quán)以及損害賠償請求權(quán)。雖然物權(quán)本身為絕對權(quán)、對世權(quán)，但物權(quán)請求權(quán)卻與債權(quán)請求權(quán)相類似，具有一定的相對性，雖然物權(quán)請求權(quán)與債權(quán)請求權(quán)同為請求權(quán)，但由于其源生于物權(quán)，與物權(quán)本身無法脫離，其自身性質(zhì)必然受到物權(quán)絕對性的影響。同時，訴訟時效作為一種能夠保障法的效率、公平和秩序等價值實現(xiàn)的制度設(shè)計，其適用客體包括債權(quán)請求權(quán)等一般請求權(quán)。鑒于物權(quán)請求權(quán)的特殊性，及其與

3、物權(quán)本身的關(guān)系，關(guān)于物權(quán)請求權(quán)應(yīng)否適用訴訟時效制度自然會引起爭議，不同的學(xué)者對此觀點不一，并且各個國家的立法或判例也對此做出了不同的規(guī)定，整體看來基本可以歸為三種學(xué)說：肯定說、否定說與折中說。本文贊同否定說的觀點，認為物權(quán)請求權(quán)不應(yīng)適用訴訟時效制度。筆者認為，物權(quán)請求權(quán)的性質(zhì)本身決定了物權(quán)請求權(quán)不宜適用訴訟時效制度：物權(quán)請求權(quán)既非債權(quán)或債權(quán)請求權(quán)，亦非獨立之請求權(quán)，而是物權(quán)所生之權(quán)利；而且物權(quán)請求權(quán)適用訴訟時效制度與訴訟時效自身的價值追
