    • 簡介:南京師范大學(xué)碩士學(xué)位論文高等教育中的懲戒姓名桂琴申請學(xué)位級別碩士專業(yè)馬克思主義理論與思想政治教育指導(dǎo)教師謝樹平20061101摘要人們良好品德的形成離不開法紀的約束和教育的引導(dǎo)。高等學(xué)校離不開教育懲戒。本文對學(xué)校教育中的懲戒、懲戒權(quán)的含義進行了界定,概括了教育懲戒的基本要素及實旋教育懲戒的一般模式。分析了目前我國高等學(xué)校中實施教育懲戒存在的一些突出問題對高校教育懲戒行為的性質(zhì)缺乏統(tǒng)一認識,存在迎合學(xué)生不敢教育懲戒的現(xiàn)象,以及存在教育懲戒不合法、不合情理等現(xiàn)象。針對上述問題,提出了要正確實施教育懲戒,必須遵循尊重、教育、法治、公正、適時、適度等原則。要對教育懲戒的實施操作程序加以規(guī)范,高校教育懲戒的操作程序主要包括錯誤認定、做出懲戒決定并送達被懲戒人、申訴復(fù)議、監(jiān)督執(zhí)行、反饋與追蹤教育等。只有教育懲戒程序規(guī)范,才能確保高校教育懲戒合法、合理、公正、公平。探討了在高等學(xué)校中發(fā)揮教育懲戒積極作用的措施加強法治意識,依法使用教育懲戒;提高教育理論及道德修養(yǎng),科學(xué)地藝術(shù)地使用教育懲戒成立高校學(xué)生自治管理委員會,讓學(xué)生自主地使用教育懲戒營造有利于高校教育懲戒的環(huán)境氛圍。沒有一種教育方法是完美的,教育懲戒也不能孤立地使用,應(yīng)該與其他教育方法結(jié)合在一起使用,尤其應(yīng)該與激勵、溝通、感化、寬容等教育方法結(jié)合在一起使用,因勢利導(dǎo),這樣才能充分發(fā)揮其獨特的功能。關(guān)鍵詞高等教育教育懲戒懲戒原則操作程序懲戒措施
