簡(jiǎn)介:西安建筑科技大學(xué)碩士學(xué)位論文管理哲學(xué)視域下的網(wǎng)絡(luò)管理倫理研究專業(yè)管理哲學(xué)碩士生張佩指導(dǎo)教師顧凡教授摘要摘要隨著網(wǎng)絡(luò)技術(shù)的迅猛發(fā)展網(wǎng)絡(luò)生活已逐漸成為人們社會(huì)生活的重要組成部分,對(duì)社會(huì)的發(fā)展及人們的生活方式產(chǎn)生了積極影響。與此同時(shí)在網(wǎng)絡(luò)世界中也出現(xiàn)了自由與責(zé)任失衡、網(wǎng)絡(luò)誠(chéng)信缺失、人際關(guān)系的冷漠與疏遠(yuǎn)、信息霸權(quán)盛行等倫理道德問(wèn)題,這些網(wǎng)絡(luò)失范行為會(huì)對(duì)和諧社會(huì)建構(gòu)和社會(huì)安定團(tuán)結(jié)產(chǎn)生嚴(yán)重危害,因此,網(wǎng)絡(luò)倫理建設(shè)問(wèn)題越來(lái)越引起人們的重視。建構(gòu)一種符合社會(huì)發(fā)展并能促進(jìn)人的全面發(fā)展的網(wǎng)絡(luò)倫理,是當(dāng)今亟待解決的問(wèn)題。研究網(wǎng)絡(luò)倫理的建構(gòu),具有重要的理論意義和現(xiàn)實(shí)意義。本文運(yùn)用功利主義理論和權(quán)利論與義務(wù)論倫理理論,在對(duì)國(guó)內(nèi)外網(wǎng)絡(luò)倫理研究現(xiàn)狀進(jìn)行梳理和歸納的基礎(chǔ)上,對(duì)網(wǎng)絡(luò)倫理問(wèn)題進(jìn)行了深入的探討。首先探討了網(wǎng)絡(luò)管理在管理哲學(xué)視域下存在的倫理問(wèn)題,闡述了自由與責(zé)任失衡,網(wǎng)絡(luò)誠(chéng)信缺失,網(wǎng)絡(luò)犯罪頻發(fā)等現(xiàn)象,分析了網(wǎng)絡(luò)倫理的特征。其次探討了網(wǎng)絡(luò)管理的倫理責(zé)任,包括網(wǎng)絡(luò)管理倫理責(zé)任的內(nèi)涵和特點(diǎn),原則和方法,對(duì)網(wǎng)絡(luò)管理的倫理問(wèn)題進(jìn)行了哲學(xué)反思和倫理學(xué)分析。最后對(duì)網(wǎng)絡(luò)倫理的建構(gòu)進(jìn)行了探討,分別從網(wǎng)絡(luò)社會(huì)倫理構(gòu)想,積極社會(huì)心理建構(gòu),網(wǎng)絡(luò)社會(huì)管理制度建構(gòu)等三個(gè)方面對(duì)和諧網(wǎng)絡(luò)社會(huì)倫理構(gòu)想進(jìn)行了全面的論證。關(guān)鍵詞關(guān)鍵詞網(wǎng)絡(luò)倫理網(wǎng)絡(luò)管理網(wǎng)絡(luò)輿論倫理責(zé)任

簡(jiǎn)介:閱卷權(quán)是辯方獲取充分信息實(shí)現(xiàn)有效辯護(hù)的重要制度設(shè)計(jì),是保障被告人充分行使防御權(quán)的重要手段。在奉行被告人訴訟主體和控辯平衡理論的現(xiàn)代刑事訴訟體系下,被告人才是閱卷權(quán)的主體,而且其本人有權(quán)親自行使該權(quán)利。目前,被告人閱卷權(quán)已經(jīng)被眾多國(guó)際公約所明確,其中依據(jù)歐洲人權(quán)公約設(shè)置的人權(quán)法院的實(shí)踐極大地豐富了公約中有關(guān)被告人閱卷權(quán)的內(nèi)容,為成員國(guó)完善閱卷制度提供了重要參考,在其判例的影響下確認(rèn)被告人的閱卷權(quán)已經(jīng)成為現(xiàn)代法治國(guó)家刑事訴訟法的調(diào)整方向。在這樣的國(guó)際背景下,我國(guó)立法仍然堅(jiān)守“閱卷權(quán)歸屬辯護(hù)人”的傳統(tǒng)觀念,閱卷制度的設(shè)置與完善始終圍繞辯護(hù)人展開,卻禁止被告人直接接觸案卷。這樣的權(quán)利設(shè)置始終沒(méi)能解決無(wú)辯護(hù)人的被告人的閱卷問(wèn)題,同時(shí)由于閱卷權(quán)歸屬辯護(hù)人而在權(quán)利位階上無(wú)法實(shí)現(xiàn)同控方權(quán)利的對(duì)等,使得辯護(hù)人行使閱卷權(quán)受到頗多限制,產(chǎn)生了困擾已久的“閱卷難”問(wèn)題,這樣的立法和實(shí)踐操作值得反思和檢討?;谌藱?quán)法院做法的代表性和深遠(yuǎn)影響,本文通過(guò)判例分析,對(duì)人權(quán)法院操作下的閱卷制度進(jìn)行了系統(tǒng)總結(jié),并以此為參考重新審視閱卷權(quán)理論。通過(guò)對(duì)我國(guó)有關(guān)閱卷的法律規(guī)定和理論研究進(jìn)行梳理,分析了被告人享有并行使閱卷權(quán)的必要性,為立法賦予被告人閱卷權(quán)掃清理論上的障礙,并結(jié)合我國(guó)現(xiàn)有的訴訟制度嘗試構(gòu)建我國(guó)的被告人閱卷制度。除引言外,本文主要內(nèi)容有四個(gè)部分。第一部分是我國(guó)閱卷權(quán)的立法沿革。這一部分分成兩個(gè)層次,一是閱卷制度的立法沿革,從主體、時(shí)間、范圍、保障措施和新的突破五個(gè)方面對(duì)我國(guó)的閱卷制度進(jìn)行了系統(tǒng)梳理,并由此總結(jié)出我國(guó)現(xiàn)行的閱卷制度是以辯護(hù)人特別是辯護(hù)律師為核心的,在這一制度下完全排除了被告人閱卷的可能性;二是對(duì)現(xiàn)行閱卷制度提出的置疑,本文從辯護(hù)率低、被告人與辯護(hù)人之間的信賴和辯護(hù)人職業(yè)風(fēng)險(xiǎn)等三個(gè)方面分析,認(rèn)為現(xiàn)有的閱卷制度并不能滿足辯方獲取案卷信息的需要。第二部分是有關(guān)閱卷權(quán)權(quán)屬之爭(zhēng)。閱卷制度發(fā)展和改革具有局限性的原因之一是理論研究缺少對(duì)被告人閱卷權(quán)的關(guān)注,面對(duì)著司法實(shí)踐中存在的問(wèn)題,并受域外閱卷權(quán)發(fā)展的影響,理論界和實(shí)務(wù)界首先就閱卷權(quán)歸屬這一根本性問(wèn)題掀起了一場(chǎng)大討論。本文將其總結(jié)為三種學(xué)說(shuō)一元說(shuō)主張閱卷權(quán)是辯護(hù)人的固有權(quán)利,反對(duì)賦予被告人閱卷權(quán),持有該觀點(diǎn)主要是出于三點(diǎn)考慮,一是法律未賦予,二是被告人言辭證據(jù)提供者的角色,三是被告人閱卷會(huì)帶來(lái)一系列的消極后果。二元說(shuō)認(rèn)為被告人是閱卷權(quán)的權(quán)利主體,辯護(hù)人閱卷權(quán)是派生權(quán)利,該說(shuō)從閱卷權(quán)權(quán)利價(jià)值、被告人的訴訟地位以及我國(guó)辯護(hù)率普遍偏低的司法現(xiàn)狀幾個(gè)方面論證了賦予被告人閱卷權(quán)的正當(dāng)性。多元說(shuō)支持二元說(shuō)閱卷權(quán)歸屬被告人的觀點(diǎn),并在此基礎(chǔ)上認(rèn)為被告人的近親屬也應(yīng)享有該權(quán)利,但基于各方利益的考量,可以對(duì)被告人近親屬的權(quán)利設(shè)置一定的限制。第三部分是歐洲人權(quán)法院的處理模式。這一部分是本文的重點(diǎn)內(nèi)容,又分為了三個(gè)層次第一,簡(jiǎn)要介紹歐洲人權(quán)公約與歐洲人權(quán)法院,對(duì)公約內(nèi)相關(guān)聯(lián)的條文內(nèi)容做了必要解讀,并對(duì)歐洲人權(quán)法院的設(shè)立和作用進(jìn)行說(shuō)明。第二,以諸多相關(guān)案例為依托整理出歐洲人權(quán)法院有關(guān)閱卷權(quán)的處理模式,在人權(quán)法院看來(lái)閱卷權(quán)的客體是國(guó)家已經(jīng)取得或可能取得一切信息,并明確被告人是閱卷權(quán)的主體,也承認(rèn)辯護(hù)人的閱卷權(quán),將二者的權(quán)利視為一個(gè)整體。行使閱卷權(quán)的時(shí)間原則上同受控訴的時(shí)間一致,但對(duì)于人身可能受到拘束的被告人適當(dāng)?shù)胤艑掗喚頇?quán)的適用。人權(quán)法院認(rèn)為閱卷權(quán)是可以受到限制的,可以為了特定利益的需要限制閱卷權(quán)的行使,但是限制屬于閱卷權(quán)的例外,應(yīng)當(dāng)經(jīng)合理程序予以明確。如果閱卷權(quán)受到侵犯,成員國(guó)應(yīng)當(dāng)為被告人提供救濟(jì)途徑。第三,對(duì)歐洲人權(quán)法院視野下的閱卷權(quán)的評(píng)述,在上一部分的基礎(chǔ)上理出閱卷權(quán)的基本輪廓,分析了人權(quán)法院與成員國(guó)在被告人閱卷權(quán)的法理邏輯上的差異,并對(duì)其操作模式作出簡(jiǎn)要評(píng)價(jià)。第四部分是構(gòu)建我國(guó)的被告人閱卷權(quán)。這一部分由兩層次組成,首先是制度構(gòu)建的整體思路,通過(guò)回應(yīng)前文有關(guān)閱卷權(quán)權(quán)屬的爭(zhēng)論,提出了本文制度構(gòu)建的整體思路,即以承認(rèn)閱卷權(quán)歸屬被告人為前提的,被告人與辯護(hù)人共同行使閱卷權(quán)的二元主體的閱卷制度,并詳盡闡述了賦予被告人閱卷權(quán)以及保留辯護(hù)人閱卷權(quán)的必要性,為整體思路提供理論上的支撐。其次就是制度的具體構(gòu)建,在我國(guó)現(xiàn)有的訴訟制度下,融合域外的主要是人權(quán)法院的具體操作,嘗試著從主體、范圍、時(shí)間、地點(diǎn)與方式以及侵權(quán)救濟(jì)五個(gè)方面構(gòu)建符合我國(guó)司法現(xiàn)狀的閱卷制度。
