簡介:“依法行政”是現(xiàn)代教育行政實(shí)踐的根本要求,如何規(guī)范教育管理、嚴(yán)格執(zhí)法、提高教育管理的效率、培養(yǎng)一只廉潔、高效的教育行政管理隊(duì)伍對(duì)我國高等教育的健康發(fā)展以及對(duì)國民素質(zhì)的提高都具有十分重要的意義。所謂依法行政是指行政機(jī)關(guān)管理公共事務(wù)必須由法律授權(quán)并依據(jù)法律規(guī)定行使行政權(quán)力,法律是行政機(jī)關(guān)據(jù)以活動(dòng)和人們對(duì)該活動(dòng)進(jìn)行評(píng)判的標(biāo)準(zhǔn),依法行政反映了社會(huì)從人治向法治轉(zhuǎn)變的歷史進(jìn)程。本文在充分吸收國內(nèi)外相關(guān)理論成果的基礎(chǔ)上,以政策、法律文本及相關(guān)案例為主要研究素材,采用法理分析方法、案例分析方法、社會(huì)調(diào)查方法等對(duì)我國高等教育管理的依法行政問題進(jìn)行研究。針對(duì)目前高等教育管理依法行政存在的教育行政立法滯后、行政管理權(quán)力約束機(jī)制不健全、管理程序正當(dāng)性的缺位、司法實(shí)踐的盲區(qū)和法治內(nèi)驅(qū)動(dòng)力不足等問題,提出了“法治三角力量”介入高等教育行政管理的觀點(diǎn),即主張構(gòu)建一個(gè)以高等教育管理依法行政的法治保障模式為核心的多元力量治理格局。通過對(duì)教育立法機(jī)制、教育執(zhí)法機(jī)制與教育司法整合這三種力量“推與拉”的作用,實(shí)現(xiàn)三種力量的平衡與協(xié)調(diào),有效維護(hù)高等教育管理中的依法行政,促進(jìn)高等教育的法治化進(jìn)程。同時(shí),改變高等教育管理中法治意識(shí)欠缺的現(xiàn)狀,找到社會(huì)發(fā)展與高等教育發(fā)展的統(tǒng)一契合點(diǎn),實(shí)現(xiàn)高等教育行政權(quán)益保護(hù)與高等教育秩序的雙贏。本文側(cè)重于理論研究,意在為促進(jìn)高等教育行政管理的法治化,維護(hù)教育行政的正當(dāng)權(quán)益,減少高等教育領(lǐng)域內(nèi)的法律糾紛,優(yōu)化高等教育行政管理秩序提供一定的理論借鑒。

簡介:江西師范大學(xué)碩士學(xué)位論文高等師范教育實(shí)踐教學(xué)體系的探討姓名賴志群申請(qǐng)學(xué)位級(jí)別碩士專業(yè)教育碩士教育管理指導(dǎo)教師周鴻敏20031001高等師范教育實(shí)踐教學(xué)體系的探討引言人類社會(huì)進(jìn)入到21世紀(jì),科學(xué)技術(shù)突七猛進(jìn),能否擁有高層次、高質(zhì)量的人才,確是關(guān)系到一個(gè)國家、一個(gè)民族命運(yùn)之大事,而人才的培養(yǎng),教育至關(guān)重要,其中,高等師范教育更是重中之重。鄧小平同志曾指出“一個(gè)學(xué)校能不能為社會(huì)土義培養(yǎng)出德、智、體全面發(fā)展,有社會(huì)主義覺悟的有文化的勞動(dòng)者,關(guān)鍵是教師?!?9年9月國家教委在北京召開的全國師范教育工作會(huì)議上,李嵐清副總理指出“大力辦好師資教育,培養(yǎng)和培訓(xùn)高水平的教師,己經(jīng)成為參與國際競爭的一項(xiàng)先導(dǎo)性戰(zhàn)略措施,科技興國,教育為木,振興教育,師資先行”,可見師資在教育中的地位之關(guān)鍵。高師院校擔(dān)負(fù)著培養(yǎng)各類師資的任務(wù),應(yīng)當(dāng)在這方面有更大的作為。從21世紀(jì)世界范圍的社會(huì)發(fā)展和教育改革來看,主張學(xué)校教育與社會(huì)實(shí)踐應(yīng)有更廣泛的接觸,以使學(xué)生能從其生活的周圍環(huán)境中,從一些社會(huì)實(shí)踐活動(dòng)中去學(xué)習(xí)和運(yùn)用知識(shí),這已成為教育的一種趨勢(shì)。聯(lián)合國教科文組織認(rèn)為,教育的四個(gè)支柱是“學(xué)會(huì)認(rèn)知、學(xué)會(huì)做事、學(xué)會(huì)共同生活、學(xué)會(huì)生存”并認(rèn)為“在任何一種有組織的教育中,這四種知識(shí)支柱中的每一種應(yīng)得到同等重視川”。“學(xué)會(huì)做事、學(xué)會(huì)共同生活、學(xué)會(huì)生存”都強(qiáng)調(diào)了學(xué)與做的結(jié)合,要求教育者考慮“如何教會(huì)學(xué)生實(shí)施他所學(xué)的知識(shí)如何使教育與未來的工作相適應(yīng)”所以,要使我國教育的發(fā)展不落后于世界教育發(fā)展的水平,就必須注重高師院校師范生的教育實(shí)踐能力的培養(yǎng)。但是,據(jù)筆者調(diào)查,不少高師院校由于受片面追求“學(xué)術(shù)性”、“向綜合大學(xué)看齊”等思想的影響,在教學(xué)領(lǐng)域不同程度地存在著重知識(shí)傳授、輕能力培養(yǎng)重學(xué)術(shù)水平的提高,輕教育實(shí)踐能力的培養(yǎng)的傾向。這種忽視對(duì)師范生進(jìn)行教育實(shí)踐能力培養(yǎng)的傾向,致使一些師范生當(dāng)了教師之后卻不會(huì)教、不善教。高師生這種情況嚴(yán)重影響了高師在教師培養(yǎng)體系中和中小學(xué)的形象,也阻礙著高師生在職后教師專業(yè)的自我成長?;幢泵禾繋煼秾W(xué)院曾做過一項(xiàng)畢業(yè)生追蹤調(diào)查,調(diào)查結(jié)果顯示,91的同學(xué)反映,他們走上中學(xué)教學(xué)崗位后暴露出來的主要問題,不是自己“不會(huì)”而是不知道怎么教學(xué)生“會(huì)”。所以嚴(yán)峻的事實(shí)告訴我們,重視和加強(qiáng)高師學(xué)生教育能力的培養(yǎng),確實(shí)到了十分迫切的地步。對(duì)此,筆者從師范院校在學(xué)生教育實(shí)踐能力培養(yǎng)方面存在的問題出發(fā),認(rèn)為實(shí)踐教學(xué)在提高師范生教育教學(xué)能力方面起了一個(gè)很大的作用,本文以此為突破點(diǎn),從高師教育實(shí)踐教學(xué)現(xiàn)狀出發(fā),試圖探索LH一條高師教育實(shí)踐教學(xué)體系的新路子,讓高師學(xué)生在步入工作崗位時(shí),能更快的向教師這一職業(yè)角色轉(zhuǎn)換。第一章實(shí)踐教學(xué)高等師范教育的貢要內(nèi)容11概念的界定11實(shí)踐現(xiàn)代漢語大詞典中解釋說實(shí)踐是指人們改造自然和改造社會(huì)有意識(shí)的活動(dòng)。本文
