4、aw countries, which advocate right supremely, also imposes restriction more or less like the Special Portion System on the freedom of testament to protect the interests of some special obligee in order to achieve social

5、justice. The current law of succession of our country fails to limit the freedom of testament because of its carelessness in legislation and do serious harm to the other relatives, running counter to our family tradition

6、 of moral principles. In this article the author introduces and analyzes the system of testamentary freedom and limitation of the main countries in the world and the flaws of the relevant system of our country , and elab

7、orates the special portion system, putting forward tentative ideas about constructing the Special Portion System in China. Except the introduction and the conclusion part, the paper falls into five parts. In the first

8、part, the author gives a general introduction of the history and development of the will succession. This part analyses in the angle of history the reason why the will succession was established to provide our system wit

9、h reference. The second part points out the reason why the principle needs necessary restriction in angles of philosophy of law and ethnics so that the will freedom principle should be restricted properly and reasonably
