1、隨著社會(huì)中主義市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展和社會(huì)主義法制的不斷健全，法律翻譯突破了以往零散的翻譯模式，日趨形成一個(gè)專門(mén)的行業(yè)，但是文化不對(duì)等仍然是困擾法律翻譯者的最大障礙之一。以著名語(yǔ)言學(xué)家及翻譯家尤金·奈達(dá)于20世紀(jì)70年代提出的功能對(duì)等翻譯理論為基礎(chǔ)，本文就《我國(guó)如何制定法律》這一翻譯項(xiàng)目，從詞匯和句法層面，對(duì)中美立法機(jī)制和程序翻譯上的不對(duì)等進(jìn)行分析并指出篇章風(fēng)格上的一些特征。
報(bào)告首先從國(guó)際交流、翻譯的行業(yè)化和法律翻譯的困難等
2、幾個(gè)角度介紹了該翻譯項(xiàng)目的重要性，并闡述了中國(guó)法律翻譯的發(fā)展現(xiàn)狀及本項(xiàng)目的開(kāi)展過(guò)程。就翻譯過(guò)程中出現(xiàn)的問(wèn)題，報(bào)告重點(diǎn)分析了中美立法機(jī)制和程序中詞匯、句法結(jié)構(gòu)的不對(duì)等。詞匯上的不對(duì)等主要表現(xiàn)在意義上的局部不對(duì)等和完全不對(duì)等，句法上的不對(duì)等則表現(xiàn)在中美立法語(yǔ)言的語(yǔ)態(tài)、詞性、詞序和連接上的差異，同時(shí)給出遵循功能對(duì)等原則的譯法，進(jìn)而指出立法翻譯中的首要原則是意義對(duì)等。接著報(bào)告闡述了中美立法語(yǔ)言在在篇章風(fēng)格上具有客觀精確、莊嚴(yán)正式等共同特征，指出
